As Judge Diane E. Gibbons waited until the very last minute before accepting the Motion to Reconsider and informing the lawyers on her decision, a motion to appeal was filed in order to protect our ability to appeal the decision rendered on June 6th, 2011 (and subsequently reaffirmed on June 14th, 2011).

For some reason that has yet to be articulated, Judge Diane E. Gibbons cancelled the hearing upon learning of the filing of the appeal.
