On July 1st, 2011 – the attorney filed a Motion for Reconsideration with Family Court Judge, Diane E. Gibbons.  The motion was very specific in that we were requesting that the trial court’s order of June 6th, 2011 and any subsequent orders based upon the June 6th order be vacated as they related to speech and/or the website thepsychoexwife.com.

A notice and courtesy copy was hand-delivered on July 1st, 2011 as time was of the essence.  The final date to file an appeal of the decision to a higher court was July 6th, 2011.

Judge Diane E. Gibbons waited until late in the day on July 6th, 2011 to notify her acceptance of the motion and ordered a hearing to be undertaken on August 15th, 2011.

Due to the 11th-hour notification that the Motion for Reconsideration had been granted, we were left with no choice but to file our notice of appeal to the higher court.  This was done on July 6th, 2011 – the last day on which we were able to file.  (See: Concise Statement of Matters Complained of on Appeal)

On July 8th, 2011 – the law firm received word of Judge Diane E. Gibbons’ intention to cancel the reconsideration hearing in light of the decision to move ahead and file for the appeal.

A letter was subsequently faxed to Judge Diane E. Gibbons asking her to reconsider her decision to cancel the hearing.

It is our understanding that the hearing has, in fact, been canceled and we must move ahead with the appeals process.
